TERMS & CONDITIONS OF THE CITY CONTEST Terms & Conditions of Contest Entry By participating in this Contest, you agree to be bound by the following Terms and Conditions, and any terms and conditions applicable to the use of www.mtvasia.com MTV Asia LDC reserves the right to amend, revise, delete, edit, add to and/or withdraw these Terms and Conditions and the prize to be awarded at any time without notice, in which event, MTV Asia LDC shall have no liability whatsoever to any person and/or entity as a result thereof. Participants will stand a chance to win a trip for two to New York City, USA. Appended terms and condition of prize redemption applies. The Contest is open to all legal residents aged 21 and above, of the following countries: Hong Kong, Indonesia, Malaysia and Singapore. Employees of MTV Asia LDC and their families are not eligible to participate in the Contest. Each entry submitted by the participant shall entitle the participant to one (1) chance to win. The prize is to be fulfilled within 2 weeks from the date of winner announcement. All entries must be received by MTV Asia LDC on or before midnight in Singapore on 19 July 2009. Proof of sending is not proof of receipt. Incomplete entries will be disqualified. The winner will be selected based on quality of entry submitted. Winner will be notified by post, electronic mail, telephone call or other modes of communication in accordance with the particulars provided by the participant during registration. MTV Asia LDC reserves the right to select an alternative winner in the event that MTV Asia LDC has reasonable grounds for believing that a selected winner has contravened any of these Terms and Conditions. Prize is non-transferable and not exchangeable for cash, unless otherwise specified herein. There shall be no substitution of prize except as determined solely by MTV Asia LDC in its sole discretion. In the event MTV Asia LDC is unable to provide the stated prize, MTV Asia LDC reserves the right to award a prize of equal or greater value. MTV Asia LDC and its respective subsidiaries, divisions, affiliates, agents, officers and/or employees shall not be liable for any claims, damage, injuries and/or loss (including but not limited to any indirect and/or consequential damage or loss) suffered by the winner in the course of his/her acceptance, use or enjoyment of the prize. These Terms and Conditions are governed by the laws of Singapore. Terms & Conditions of Prize Redemption The Prize includes two (2) adult round-trip economy class air tickets, 3-night accommodation in New York City, USA, at a hotel to be selected by MTV Asia LDC at its sole discretion, shopping allowance of USD1000, and cash allowance of USD400 per traveller. Winner and companion must be able to travel together from 6 August to 9 August 2009. Winner and companion must have passports with minimum 6-months validity and are responsible for visa application(s) to USA. Prize must be claimed between 6 August and 9 August 2009. Unclaimed prize (or portion of prize) will be forfeited. Extension is strictly not allowed. Prize includes peak season travel surcharge but excludes insurance (including but not limited to travel and medical) charges, baggage, and other incidentals. Miscellaneous costs are on winner's own expense. Miscellaneous costs include and not limited to telephone calls, mini-bars, room service and inbound transportation are not covered by the prize package. MTV Asia LDC is not responsible for any damage, loss, injury or sickness during the course of the trip. Winner and companion must sign an acknowledgement letter for the Prize and an indemnity form releasing MTV Asia LDC and its affiliates of all claims, actions, damages, liabilities, costs and expenses arising from their acceptance of the Prize, and practise due diligence to avoid endangering themselves during the trip. Winner and companion must supply a minimum of 10 digital pictures taken during the New York City trip to MTV Asia LDC by 12 August 2009. MTV Asia LDC reserves the rights to use names, likeness and pictures of winner and companion from the New York City trip in any advertising and promotion activity without prior notice, or otherwise engage them in any form of publicity for MTV Asia LDC. The decision of MTV Asia LDC on all matters relating to the selection of winner is final and no correspondence will be entertained. In the event of dispute, participant's entitlement to participate and/or receive the Prize is subject to the discretion and final determination of MTV Asia LDC.
